San Diego, CA, United States (AHN) – Automaker Toyota has agreed to settle a wrongful death lawsuit of the family of four people killed in a runaway Lexus for $10 million.

The 2009 car crash that killed an off-duty California Highway Patrol officer, his wife their daughter and the trooper’s brother-in-law led to the recall of millions of vehicles.

The family was travelling on a suburban San Diego freeway when their car sped out of control, reaching speeds of 120 mph. The vehicle struck an SUV, went over an embankment, rolled several times and then burst into flames.

Accident investigators concluded that a faulty floor mat was to blame and Toyota recalled millions of cars to replace their floor mats. Another recall followed involving replacing pedals that could potentially stick.

Toyota reached a confidential settlement agreement with the family in September and declined to publicly announce the figure. However a lawyer for the dealership that lent the family the vehicle released the amount.

Toyota did not admit or deny liability in the settlement but released a statement expressing its disappointment in the public revelation of the settlement amount.

The car maker said: “As is common in these cases, these parties agreed to keep the amount confidential, in part to protect the families from unwanted solicitations and to allow them to move on from this difficult period.”
